What do you guys think of bill 32 that is re-introduced by Niagara MPP Kim Craitor? It is called the Right of Passage Act. You can read about it here. http://niagaraatlarge.com/2010/04/15/water...t-lakes-shores/

Part of it is. The legislation prohibits property owners living adjacent to the waterfront from claiming and barricading beaches by putting fences out way into the water and allowing them to assert the beachfront as private and exclusive property.

Well I haven't read the bill but you might as well scrap it right now. Kim waited way too long to reintroduce it again and it's bound to die before the next election and that will kill all private member's bills no matter how far they've gotten. Kim did the same thing last term.

I myself am a member of the Shorewalk Association and believe we should be able to use the waterfront as a highway "when walking" without being harassed. However with that said I have done allot of work along the waterfront and see how inconsiderate the public can be. The shore residents pay huge taxes (a waste of money IMO) to Live on the beach and they take dam good care of it which can also cost a bundle. Most live there for 3 month out of the year so the cost is actually astronomical. Now in walks Joe public with his dog (always never leashed) and when the dog has to go he simply pretends he doesn't see it happening (and he's never prepared) and leaves it there for the residents to clean up. He then throws his water bottle or chip bag and proceeds on his marry way. Others see the well groomed beach as a canvass for their loud ATV's and dirt bikes and rip back and forth dangerously and none of these people stop and contribute a dime towards the levy collected from the municipalities for the use of these beach fronts.

Now if you want to see garbage just go to the public beach. I have cleaned litter on the private beaches that has floated or blown in but the residents in general keep their crap picked up. It would be nice if the town could use some of the ridiculous amounts of monies collected to keep the public beaches cleaned up and rotting algae taken away like on the private beaches but it doesn't get done. Chances are if the health department took samples in the middle of a long stretch of private beach that the results would come back much better.

So that is a quick backgrounder that gives reason for my answer to your question based on my past knowledge of his previous bill and the shorewalk association efforts.

I think all private residents on all disputed waterfronts should be forced to have a survey completed and boundaries clearly marked AND that Joe public may have access for walking (passing) only to get from point A to point B without being harassed. I also think the landowners around the beach should invest some of that money for security so they can catch these dirty people littering and leaving dog dirt and bring charges with big enough fines or lawsuits that make these trespassers think twice.
If you say shut up and fish then shut the hell up when they tell you that you can't fish anymore!

I agree 100% with Chili. It is a reversal of our "rights" to keep walkers from traversing the beach but the litter factor may trump the A%^holes that drop their litter the second they finish the chips or soda. It's just like the Whirlpool, one of the most beautiful places to fish but anglers and hikers alike just drop their garbage anywhere they finish using it. Makes me sick to see it.
