119 CHARGES LAID IN WINDSOR AREA ILLEGAL FISHING INVESTIGATION

A 16-month investigation into illegal fishing has resulted in 119 charges against three Windsor-area people and a Windsor business.

On May 15, 2008, Ministry of Natural Resources conservation officers executed search warrants on residences in the Town of Lasalle and a commercial establishment in the City of Windsor. Conservation officers seized two vehicles, one boat, fish processing equipment, fishing gear and a quantity of fish.

The 119 charges have now been laid against two individuals from Lasalle, one individual from Woodslee and a commercial establishment in Windsor. The charges include catching overlimits of fish, buying and selling fish illegally, transporting illegally caught fish, and illegally possessing a gill net and hook line.

Conservation officers allege that the offences took place between April 2007 and May 2008 when large quantities of fish were taken from the Detroit River and the part of Lake Erie adjacent to Essex County.

In order to harvest and sell fish in Ontario, a commercial fishing licence is required from the Ministry of Natural Resources. Fish retail outlets can only purchase fish for the purpose of resale from fish processing plants or holders of commercial fishing licences. It is also illegal for anyone to purchase or sell any angler-caught fish.

$2,320 FINE FOR COMMERCIAL FISHING VIOLATIONS

A Lake Erie commercial fishing boat captain has been fined $2,320 for breaking a number of fishing violations.

Emilio Mauricio, 48, of Leamington, captain of the commercial fishing vessel "MI-MARK", pleaded guilty and was fined $2,320 for four fishing violations. These included failing to submit an accurate and complete daily catch report to the Ministry of Natural Resources, fishing outside of his permitted fishing grounds and allowing approximately 200 lbs. of yellow perch to spoil and become unsuitable for human consumption.

Court was told that on August 21, 2007, conservation officers investigated an alleged incident of inaccurate information being reported on a daily catch report involving the commercial fishing vessel "MI-MARK" while it was fishing out of the port of Erieau, on Lake Erie. Further investigation also determined that the fishing vessel was fishing in Chatham-Kent waters and not Elgin County waters as reported by the captain, and that fish were permitted to spoil.

Justice of the Peace Babcock heard the federal charges in the Ontario Court of Justice in Chatham on July 17, 2008 and Justice of the Peace Hurst heard the provincial charges in the Ontario Court of Justice in Chatham on August 13, 2008.

$2500 FINE FOR COMMERCIAL FISHING VIOLATION

A commercial fishing boat captain has been fined $2500 for not reporting fish caught over his quota and discarding the dead fish in Lake Erie rather than turning them over to a conservation officer.

Lino Cabral, 51, of Wheatley, captain of the commercial fishing boat Teresa Maria, pleaded guilty to violating the conditions of his commercial fishing licence.

Ministry of Natural Resources conservation officers received information alleging that Cabral had dumped about 70 kilograms of dead yellow perch from his boat into Lake Erie off the shores of Chatham-Kent. Conservation officers investigated the alleged incident and determined that Cabral was trawling for smelt and had previously caught his quota of yellow perch. He did not report the discarded yellow perch on the daily catch report and did not give the fish to a conservation officer as required.

Justice of the Peace Brode heard the federal charges in the Ontario Court of Justice in Windsor on August 20, 2008.

ANGLERS FINED FOR USING TOO MANY LINES

September 23, 2008

Three Michigan anglers and a Windsor resident have been fined $1,005 for fishing with more than two lines on Lake Erie and Lake St. Clair this summer. A bench warrant was issued for the arrest of a fourth Michigan angler when he failed to appear in Chatham court.

James Lyons, 46 of Marine City, Michigan, James Schillwe, 52, of Saint Clair Shores, Michigan, and Michel Dufault, 68, of Windsor, Ontario, were each fined $235. Thomas Mayo, 43, of Clay, Michigan, was fined $300. The seized fishing rods will be returned when the fines are paid.

Justice of the Peace Maureen Ryan-Brode heard the two cases in the Ontario Court of Justice, Windsor, on September 17. The remaining four cases were heard by Justice of the Peace Calvin Hurst in the Ontario Court of Justice, Chatham on September 18, 2008.

$3,000 FINE FOR COMMERCIAL FISHING VIOLATION

A Lake Erie commercial fishing boat captain and a Wheatley commercial fishing company have each been fined $1,500 for not reporting accurately a catch of whitefish from Lake Erie.

Angelo Coppola, of Leamington, captain of the commercial fishing boat Miss Melissa II, and Saco Fisheries Limited, Wheatley, owner of the commercial fishing licence, were found guilty of violating the conditions of their commercial fishing licence.

An investigation by a Ministry of Natural Resources conservation officer found that Coppola had not declared 321 kilograms (707 pounds) of whitefish he caught on November 28, 2007, and landed at Kingsville.

Justice of the Peace Maureen Brode heard the federal charges during a trial in the Ontario Court of Justice, Windsor, on April 9, 2008. The penalty was set on October 1, 2008.
